Question Details: I just sighned a year lease in S.F. the lease speficaly says no inhabitants in basement . It is an inlaw cottage and it has seperate entrance no running water and no bathroom to safely dispose of human waist .so it can,t be legaly rented as living quarters.the person who wanted to store his belongings with the last tennent has moved himself in and 3 friends have joined him.He is going to get me evicted can l give him notice and lock him out .how do l do it?

    Tell your landlord about it.

    Check with local law inforcement and if they cause trouble call the police and that will solve everything also be sure to contact your landlord and tell them

    According to “just causes for eviction” from Tenant Rights Union, one of the just causes is

    “2. The tenant has violated a term of the rental agreement or lease and has received written notice about this from the landlord and has not corrected the violation;”

    and

    ” 4. The tenant is using the unit for an illegal purpose;”

    So who is this guy and what’s his relation to you? If he has no relations to you, then it’s the landlord’s problem. If he’s sub-leasing the basement from you for storage, I hope you have a lease agreement signed, as it’s time to began eviction proceedings, even if you’re just a “sub-landlord”.

    If you do have landlord - tenant relations with the guy, then it’s time to check this chart:

    EDIT: do NOT lock him out. That can be counted as you harassing a tenant (assuming he’s subleasing the basement from you).
